Trademarks are a big deal in wrestling, and WWE looks to take ownership whenever they can. However, their attempt to trademark the name “Keith Lee” looked to have failed after Keith Lee filed to trademark his birth name for himself. WWE applied to the United States Patent and Trademark Office to trademark his name when he was still in NXT. Still, the law requires Lee to sign a consent form giving WWE permission. Lee didn’t do this, but now his own application has encountered issues.
The first issue is the fact that WWE’s application is still pending and was filed before his. Secondary Lee’s evidence of prior usage was deemed only to confirm him as a specific individual and not as a service mark to identify a service. It appears Lee’s attorney mainly used news articles and a YouTube video of him wrestling Scott Mckenzie on the independents from 2008 to verify his application.
What this means for the trademark remains to be seen, with it appearing both WWE and Lee applications are in limbo, much like the state of his career presently. Lee hasn’t wrestled for WWE since February, and there have been rumors that Lee has been suffering from health issues and been unable to get cleared to return. However, that hasn’t yet been officially confirmed.
