Last year, news broke that Wesley Eisold of the punk rock group American Nightmare had filed a lawsuit against WWE, Fanatics, and Cody Rhodes for breach of contract and trademark infringement. According to legal documents, the musician had registered the trademark for the name in 2016, and once Rhodes wanted to use it himself, he paid Eisold $30,000 and agreed his name or image would always be included on merchandise to ensure there was no confusion for fans.
However, Eisold claimed that WWE and Fanatics failed to do this and, thus, began legal action in an attempt to claim damages. And now, in an update from PostWrestling.com that won’t shock anyone, it has been confirmed that a settlement has been reached, although the terms have not been made public.
Second-generation wrestler Rhodes started using the name “American Nightmare” as a play on his father, Dusty Rhodes, who was well-known for his nickname “American Dream,” after being encouraged to do so by New Japan. Yet, it should be noted that his older brother, Dustin, used the moniker himself in the 1990s and previously stated that he signed the rights over to Cody, seemingly indicating that this whole legal situation was anything but straightforward.
