Tool Might Be Getting Sued Over Festival Performance

Tool made headlines recently for getting booed at their own “Tool Live In The Sand” festival that took place last weekend in Mexico. The 3-day event featured headline performances by the show’s namesake on the first two nights, but fans were upset at the lack of diversity in the setlist on the second night given the high cost of attending the event. 

The band was met with audible boos during their Saturday night show, and several fans took to Reddit to complain about the event. “People paid $3k for a ‘unique’ experience and setlist (which is literally what the festival claimed they would have and marketed it as such), and they ended up playing basically the same setlist they’ve played for the past two years on tour, with almost no variation from night one to night two,” wrote one disappointed fan. 

Now a “Tool Live In The Sand” concertgoer who is also a lawyer is considering a class action lawsuit against the band. Metal Hammer confirmed the news, and lawyer Stasio French Rusek said: “These were my 27th and 28th Tool shows. There was a palpable sense of betrayal in the air as the show began the second night, and it lingered throughout the remainder of the weekend.”

He continued: “What it boils down to is that purchasers of the festival package were promised ‘two unique sets’ by Tool. While the comments on these posts argue about what ‘unique’ means, the reality is that the opportunity to see Tool play two unique sets, ie no repeats, was the determining factor for most attendees to pull the trigger on spending thousands of dollars to attend.”

Nearly half of Tool’s set on the second night consisted of songs from Night 1.
