Earlier this year, shock rocker Marilyn Manson appeared in a New Hampshire courtroom to plead no contest to a misdemeanor simple assault charge. He was charged with two misdemeanor accounts for allegedly blowing his nose and spitting on a videographer. The second charge was dismissed.

“I was right there when it happened, she was beyond furious when he did that to her,” a security guard said of the 2019 New Hampshire incident. “He spit on her a couple of times and then leaned real close to the camera and blew a huge snot rocket on her. After he did that, she almost threw her camera right down on the ground.”

Now according to Rolling Stone, the civil lawsuit, which was originally dismissed because the plaintiff failed to appear, has been revived. The lawyer for the videographer, Susan Fountain, was apparently suffering from a serious medical issue during the original trial date, and she said she forgot to enter the trial date into her calendar.

A judge ruled that the lawyer caught the mistake before the six-month deadline to appeal the dismissal. No-one from Manson’s legal team was present for the hearing.

“Plaintiff not only suffered emotional distress from the offensive touching itself, but also from the fear and anxiety that she could have potentially contracted a communicable disease as a result of the exposure to defendant’s bodily fluids,” reads a portion of Fountain’s filing. “She was forced to undergo medical testing immediately following the incident and several months later to ensure that she had not contracted a serious disease.”
